Adam Schiff<\/strong> (D-Calif.) pressed Quintenz on the CFTC\u2019s handling of prediction markets that allow bets on sports outcomes. <\/p>\n<p>California tribes have expressed concerns that such markets violate their exclusivity agreements with states.<\/p>\n<p>Quintenz responded by emphasizing that the current law outlines which event contracts are permissible. <\/p>\n<blockquote><p>I believe the law is very clear about the purpose of derivative contracts, and about events that have financial or economic consequences qualifying as commodities<\/p><\/blockquote>\n<p>However, he did not directly address the legal ambiguity around <a href=\"https:\/\/www.legitgambling.com\/sports-betting\">sports betting markets<\/a> specifically.<\/p>\n<blockquote><p>I would pledge to you&#8230; that I would have a very robust all-stakeholder engagement process. I would listen to the concerns of the tribes that you mentioned<\/p><\/blockquote>\n<p>Still, what that process would look like, or whether it would result in action, remains unclear. <\/p>\n<div style=\"position:relative;height:0;padding-bottom:56.25%\">\n<iframe loading=\"lazy\" src=\"https:\/\/www.youtube.com\/embed\/tu3kPSlWVkw?rel=0&amp;showinfo=0?ecver=2\" width=\"640\" height=\"360\" frameborder=\"0\" style=\"position:absolute;width:100%;height:100%;left:0\" allowfullscreen><\/iframe>\n<\/div>\n<p>&nbsp;<\/p>\n<p>Many tribal representatives left a recent meeting with Acting Chair <strong>Caroline Pham<\/strong> feeling that the agency was unlikely to intervene. <\/p>\n<p>One attendee recalled,<\/p>\n<blockquote><p>She basically said at the outset, \u2018I\u2019m happy to talk to you, but I am out the door and I have no idea what the new director might do with this issue<\/p><\/blockquote>\n<h2>Tribes Could Offer Their Own Event Markets<\/h2>\n<p>Quintenz also floated the idea that tribes could simply offer their own event markets. <\/p>\n<blockquote><p>Nothing in the CEA, that I\u2019m aware of, prohibits&#8230; tribes to offer those products<\/p><\/blockquote>\n<p>But critics argue this sidesteps the core issue, as tribal gaming compacts often grant exclusivity, not competition.<\/p>\n<p>Pressed on whether he would appeal a court decision that ruled against sports betting contracts, Quintenz declined to commit. <\/p>\n<blockquote><p>The agency would want to ensure that it\u2019s defending the <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/7\/chapter-1\">Commodity Exchange Act<\/a><\/p><\/blockquote>\n<p>Senators also questioned his ties to Kalshi. Quintenz confirmed he would resign from its board and divest his shares if confirmed. <\/p>\n<p>\u201c<em>I will abide by all applicable ethics statutes and regulations<\/em>\u201d, he said.
